These general conditions of use define the conditions of access and use of the Pierre Fabre Foundation website.
The general conditions of use apply to all connections to the website. By connecting to the site, users acknowledge that they have read and accepted these conditions. The parents or custodians of minors using the site are deemed to have accepted these general conditions of use on their behalf.
These conditions are subject to change at any time and without notice.
Purpose of the site
This website was created to provide Web users with information about the Pierre Fabre Foundation, its organization, its programs, action and communications. The site shall not constitute a contractual offer.
Liability
The content of this site meets the applicable legal requirements. The foundation shall refrain from publishing any violent, pornographic or libelous information and/or illegal racist, xenophobic or pedophile content or content that violates the rights of third parties and/or human dignity.
However, the foundation does not guarantee the data on the site is accurate, up to date and complete. Consequently, Web users are informed that, due to the high volumes of information processed, the site may contain certain inaccuracies, omissions or typographical errors. The foundation agrees to correct these errors as quickly as possible, as soon as they come to its notice or are reported. More particularly, the Pierre Fabre Foundation shall not be held liable for:
- damage that may result, directly or indirectly, from visiting the site or from using the information on the site, and in particular any loss of financial or commercial operations or any loss of programs or data in any information system, even when the foundation has been informed of the possibility of such damage;
- damage that may result from visiting other websites by clicking on the hypertext links on the foundation’s site. Web users are solely responsible for their actions on the Internet, including the use of the links on the foundation’s website, which are provided for information purposes only. Moreover, the foundation does not provide any guarantees regarding the information published on the said sites and shall not be held liable for their content;
- hyperlinks pointing to the foundation’s website. Third parties shall obtain the foundation’s approval before creating any hyperlinks pointing to its website or one of its pages. The foundation reserves the right to demand the removal of any such links.
Moreover, the foundation shall not be held liable if the website cannot be accessed.
The foundation also reserves the right to modify and to temporarily or permanently close all or part of the site, whenever it so wishes and without notice or compensation. The foundation shall not be held liable for any modification, interruption or suspension of the site under any circumstances.
Intellectual property rights
All the images and texts on the website are the exclusive property of the Pierre Fabre Foundation.
The content available on the site may be downloaded and/or printed exclusively for private use, for non-commercial purposes, and without modifying any information about intellectual property rights, and making sure that the following statement is reproduced on every copy: “This document is from the “Pierre Fabre Foundation” website (http://www.fondationpierrefabre.org). All rights of reproduction reserved.”
Any uses other than those mentioned above are forbidden, without the prior and written approval of the foundation.
Protection of nominative data
No personal data is collected on the Pierre Fabre Foundation website without the knowledge of the Web user.
The foundation collects certain information, such as the searches made by Web users when browsing the site, but this information is used for statistical purposes only and remains anonymous.
However, when Web users want to contact the foundation, they can enter certain personal data in a contact form.
The use of this personal data is subject to the provisions of law no. 78-17, passed on January 6, 1978, amended by law no. 2004-801, passed on August 6, 2004, on information technology, files and individual freedom.
Any person whose personal data has been collected or processed through the foundation’s website has a right to access, modify, correct and delete such data, which can be exercised by writing to the Pierre Fabre Foundation’s administrative offices by post or e-mail at the following addresses (postal address: Domaine d’En Doyse, Route de Saint Sulpice, 81500 Lavaur, France. This data will only be stored and used for the sole purpose of communicating with the Internet user and may not be transmitted to third parties without the prior authorization of the Internet user. As for the e-mails sent to the foundation, they will be kept on a computer medium for the duration of the use of the Internet user’s personal data.
Cookies
Persistent cookies are used for statistical purposes only. The website does not install any other persistent cookies in the user’s browser. A session cookie is also used, which is only valid for the duration of the visit to the site.
Users who do not want the statistical software that the site uses (Google Analytics) to store any information can download a browser plug-in module that deactivates Google Analytics.
Applicable law and jurisdiction
These general conditions are governed by French law.
If no amicable agreement can be reached, any disputes regarding the interpretation or the execution of these conditions will be referred to the French courts.
